Kimbrough hired McDonald Law Firm to represent him in his slip and fall case after being turned away by numerous personal injury attorneys. Kimbrough was told by other personal injury attorneys that his case would be dismissed and it never make it to trial. On August 17, 2010, McDonald and Kimbrough walked into the Monroe County Circuit Court for trial. A jury was selected that morning and opening arguments were scheduled to begin after lunch when AutoZone Stores, Inc. elected to settle rather than proceeding with the trial. Kimbrough accepted AutoZone Stores, Inc.'s settlement of an undisclosed amount pursuant to a confidentiality agreement.
